High Court Orders Punjab Govt to Clarify Old Pension Scheme Implementation for NPS Employees
ਚੰਡੀਗੜ੍ਹ, 5 ਅਪਰੈਲ 2025( ਜਾਬਸ ਆਫ ਟੁਡੇ) ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਨੂੰ ਹੁਕਮ ਦਿੱਤਾ ਹੈ ਕਿ ਉਹ ਨੈਸ਼ਨਲ ਪੈਨਸ਼ਨ ਸਕੀਮ (NPS) ਅਧੀਨ ਆਉਣ ਵਾਲੇ ਕਰਮਚਾਰੀਆਂ ਲਈ ਪੁਰਾਣੀ ਪੈਨਸ਼ਨ ਸਕੀਮ (OPS) ਲਾਗੂ ਕਰਨ ਸੰਬੰਧੀ 18 ਨਵੰਬਰ 2022 ਦੇ ਨੋਟੀਫਿਕੇਸ਼ਨ 'ਤੇ 8 ਹਫ਼ਤਿਆਂ ਦੇ ਅੰਦਰ ਵਿਸਥਾਰ ਨਾਲ ਜਵਾਬ ਦੇਵੇ।
ਇਹ ਆਦੇਸ਼ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਕਰਮਚਾਰੀ ਕਲਿਆਣ ਸੰਗਠਨ ਵੱਲੋਂ ਦਾਇਰ ਕੀਤੀ ਸਿਵਲ ਰਿਟ ਪਟੀਸ਼ਨ ਨੰਬਰ 9223 ਆਫ 2025 'ਤੇ ਸੁਣਵਾਈ ਦੌਰਾਨ ਦਿੱਤਾ ਗਿਆ। ਪਟੀਸ਼ਨ ਵਿਚ ਦਲੀਲ ਦਿੱਤੀ ਗਈ ਸੀ ਕਿ ਨੋਟੀਫਿਕੇਸ਼ਨ ਆਉਣ ਤੋਂ ਬਾਅਦ ਵੀ ਸੂਬਾ ਸਰਕਾਰ ਵੱਲੋਂ ਅਜੇ ਤੱਕ ਕੋਈ Standard Operating Procedure (SOP) ਜਾਰੀ ਨਹੀਂ ਹੋਈ, ਜਿਸ ਕਾਰਨ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਨੁਕਸਾਨ ਹੋ ਰਿਹਾ ਹੈ।
ਨਿਆਂਮੂਰਤੀ ਹਰਸਿਮਰਨ ਸਿੰਘ ਸੈਠੀ ਨੇ ਕਿਹਾ ਕਿ ਨੋਟੀਫਿਕੇਸ਼ਨ ਆਉਣ ਨੂੰ ਲਗਭਗ ਢਾਈ ਸਾਲ ਹੋ ਗਏ ਹਨ, ਫਿਰ ਵੀ ਲਾਗੂ ਕਰਨ ਦੀ ਕਾਰਵਾਈ ਅਜੇ ਤੱਕ ਸ਼ੁਰੂ ਨਹੀਂ ਹੋਈ। ਦਿਲਚਸਪ ਗੱਲ ਇਹ ਹੈ ਕਿ ਹਿਮਾਚਲ ਪ੍ਰਦੇਸ਼ ਵਰਗੇ ਰਾਜਾਂ ਨੇ ਪਹਿਲਾਂ ਹੀ OPS ਲਾਗੂ ਕਰ ਦਿੱਤਾ ਹੈ।

ਸਰਕਾਰ ਵੱਲੋਂ ਅਦਾਲਤ ਨੂੰ ਭਰੋਸਾ ਦਿੱਤਾ ਗਿਆ ਕਿ ਪਟੀਸ਼ਨਰ ਵੱਲੋਂ 4 ਫਰਵਰੀ 2025 ਨੂੰ ਦਿੱਤੇ ਗਏ ਨੋਟਿਸ ਦਾ ਜਵਾਬ ਜਲਦ ਦਿੱਤਾ ਜਾਵੇਗਾ। ਇਸ ਉੱਤੇ ਅਦਾਲਤ ਨੇ ਹੁਕਮ ਦਿੱਤਾ ਕਿ ਪੰਜਾਬ ਦੇ ਮੁੱਖ ਸਕੱਤਰ ਵੱਲੋਂ 8 ਹਫ਼ਤਿਆਂ ਦੇ ਅੰਦਰ 'ਸਪੀਕਿੰਗ ਆਰਡਰ' ਜਾਰੀ ਕੀਤਾ ਜਾਵੇ, ਜਿਸ ਵਿੱਚ ਪੂਰੀ ਵਿਵਰਣਾ ਹੋਵੇ ਕਿ OPS ਕਿਵੇਂ ਅਤੇ ਕਦੋਂ ਲਾਗੂ ਕੀਤੀ ਜਾਵੇਗੀ।
ਅਦਾਲਤ ਨੇ ਇਹ ਵੀ ਚੇਤਾਵਨੀ ਦਿੱਤੀ ਕਿ ਜੇਕਰ ਸਰਕਾਰ ਨੇ ਹੁਕਮ ਦੀ ਪਾਲਣਾ ਨਾ ਕੀਤੀ, ਤਾਂ ਉਸਦੇ ਖਿਲਾਫ ਤੌਹੀਨ-ਅਦਾਲਤ ਦੀ ਕਾਰਵਾਈ ਕੀਤੀ ਜਾ ਸਕਦੀ ਹੈ।
ਅੰਤ ਵਿੱਚ ਪਟੀਸ਼ਨ ਨੂੰ ਨਿਪਟਾਇਆ ਗਿਆ, ਪਰ ਪਟੀਸ਼ਨਰ ਨੂੰ ਇਹ ਆਜ਼ਾਦੀ ਦਿੱਤੀ ਗਈ ਕਿ ਜੇਕਰ ਸਰਕਾਰ ਨੇ ਜਵਾਬ ਨਾ ਦਿੱਤਾ, ਤਾਂ ਕੇਸ ਨੂੰ ਦੁਬਾਰਾ ਚਾਲੂ ਕੀਤਾ ਜਾ ਸਕੇ।

Chandigarh, April 1, 2025:
In a significant development, the Punjab and Haryana High Court has directed the Chief Secretary of Punjab to issue a detailed response within eight weeks regarding the implementation of the Old Pension Scheme (OPS) for government employees currently under the National Pension Scheme (NPS).

The court was hearing Civil Writ Petition No. 9223 of 2025 filed by the Punjab and Haryana High Court Employees Welfare Association. The petition challenged the delay in executing the Notification dated November 18, 2022, which promises OPS benefits to NPS-covered employees.
Justice Harsimran Singh Sethi, who presided over the matter, observed that despite more than two and a half years passing since the notification was issued, the Punjab government has failed to release the Standard Operating Procedure (SOP) required for its implementation. This delay, the petitioner argued, has caused prejudice to the employees, especially since neighboring states like Himachal Pradesh have already rolled out similar benefits.
During the hearing, the state assured the court that the petitioner’s legal notice dated February 4, 2025, would be addressed appropriately. The court, noting this assurance, directed that a "speaking order" be issued by the Chief Secretary within eight weeks from the receipt of the certified court order, detailing the timeline and process for implementing the OPS benefits.
Justice Sethi also made it clear that failure to comply with the court’s directive may result in contempt proceedings against the state.
The petition was disposed of with liberty granted to the petitioner to revive the case if the state fails to act as promised.
