ਪੈਨਸ਼ਨਰਾਂ ਲਈ ਵੱਡੀ ਖੱਬਰ: ਹਾਈਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ਤੋਂ ਬਾਅਦ ਸੇਵਾਮੁਕਤੀ ਤੋਂ ਬਾਅਦ ਸਾਲਾਨਾ ਵਾਧਾ ਦੇਣ ਦਾ ਫੈਸਲਾ

ਪੰਜਾਬ ਅਤੇ ਹਰਿਆणा ਹਾਈਕੋਰਟ ਦੇ ਹੁਕਮਾਂ ਤੋਂ ਬਾਅਦ੍ ਸਰਕਾਰ ਵੱਲ਼ੋਂ ਸੇਵਾਮੁਕਤੀ ਤੋਂ ਬਾਅਦ  ਸਾਲਾਨਾ ਵਾਧਾ ਦੇਣ ਦੇ ਫੈਸਲੇ ਨੂੰ ਲਾਗੂ ਕਰਨ ਦੇ ਆਦੇਸ਼

ਚੰਡੀਗੜ੍ਹ 10 ਜੁਲਾਈ 2024 ( ਜਾਬਸ ਆਫ ਟੁਡੇ) 

ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ ਵਿੱਤ ਵਿਭਾਗ ਵਲੋਂ ਜਾਰੀ ਇੱਕ ਸਰਕਾਰੀ ਹੁਕਮ ਮੁਤਾਬਕ, ਸੇਵਾਮੁਕਤੀ ਤੋਂ ਬਾਅਦ ਸਾਲਾਨਾ ਵਾਧਾ ਦੇਣ ਦੇ ਮਾਮਲੇ 'ਚ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਦੇ ਫੈਸਲੇ ਨੂੰ ਲਾਗੂ ਕੀਤਾ ਜਾਵੇਗਾ। ਹਾਈ ਕੋਰਟ ਨੇ 9 ਅਪ੍ਰੈਲ 2024 ਨੂੰ ਮਲਾਗਰ ਸਿੰਘ ਬਨਾਮ ਪੰਜਾਬ ਰਾਜ ਅਤੇ ਹੋਰਨਾਂ ਦੇ ਮਾਮਲੇ 'ਚ ਫੈਸਲਾ ਸੁਣਾਇਆ ਸੀ ਕਿ ਜੇਕਰ ਕੋਈ ਸਰਕਾਰੀ ਕਰਮਚਾਰੀ 12 ਸਾਲ ਦੀ ਸੇਵਾ ਪੂਰੀ ਕਰਨ ਤੋਂ ਬਾਅਦ ਸੇਵਾਮੁਕਤ ਹੋ ਜਾਂਦਾ ਹੈ ਤਾਂ ਉਹ ਪੈਨਸ਼ਨ ਲਾਭਾਂ ਦੀ ਗਣਨਾ ਲਈ ਵਧੀਕੀ ਸਾਲਾਨਾ ਵਾਧਾ ਲੈਣ ( one annual notional increment) ਦਾ ਹੱਕਦਾਰ ਹੈ।

ਵਿੱਤ ਵਿਭਾਗ ਵੱਲੋਂ 10 ਜੁਲਾਈ 2024 ਨੂੰ ਜਾਰੀ ਕੀਤੇ ਗਏ ਇਸ ਆਦੇਸ਼ 'ਚ ਇਹ ਸਪੱਸ਼ਟ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਵਿਭਾਗ ਵੱਲੋਂ ਮਾਰਚ 2021 'ਚ ਜਾਰੀ ਕੀਤੀਆਂ ਪਿਛਲੀਆਂ ਹਦਾਇਤਾਂ, ਜਿਸ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਸੀ ਕਿ ਸਰਕਾਰੀ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਸੇਵਾਮੁਕਤੀ ਤੋਂ ਬਾਅਦ ਤਨਖਾਹ ਵਿੱਚ ਕੋਈ ਵਾਧਾ ਨਹੀਂ ਦਿੱਤਾ ਜਾਵੇਗਾ, ਨੂੰ ਹਾਈ ਕੋਰਟ ਦੇ ਫੈਸਲੇ ਰਾਹੀਂ ਰੱਦ ਕਰ ਦਿੱਤਾ ਗਿਆ ਹੈ।

Court said ,"The respondents are directed to grant the petitioners the benefit of one notional increment so as to fix their last drawn pay at the time of their retirement and their pensionary benefits be re-calculated on the basis of said last drawn pay but petitioners, as undertaken by them will not be entitled for the arrears up to the date of filing their respective petitions by them and the actual benefits of arrears upon re-fixation of their pension will be given to the petitioners from the date of filing of the writ petitions. The petitioners are held not entitled for any arrears prior to the date of filing of the writ petitions by the petitioners as agreed by them before this Court at the time of hearing. Let the re-fixation of the pensionary benefits upon revised last pay drawn be done by the respondents within a period of two months from the receipt of copy of this order and the actual arrears for which the petitioners become entitled for under this order be released to them within a period of one month thereafter."

ਇਸ ਲਈ ਸਰਕਾਰ ਨੇ ਉਪਰੋਕਤ ਪੈਰਾ  ਵਿੱਚ ਦਰਸਾਏ ਗਏ ਇਹਨਾਂ ਨਿਰਦੇਸ਼ਾਂ 'ਤੇ ਮੁੜ ਵਿਚਾਰ ਕੀਤਾ ਹੈ, ਅਤੇ ਹੁਣ ਰਾਜ ਸਰਕਾਰ ਦੇ ਉਨ੍ਹਾਂ ਸਾਰੇ ਪੈਨਸ਼ਨਰਾਂ ਨੂੰ ਇੱਕ ਨੋਸ਼ਨਲ ਸਾਲਾਨਾ ਵਾਧੇ ਦਾ ਲਾਭ ਦੇਣ ਦਾ ਫੈਸਲਾ ਕੀਤਾ ਹੈ, ਜਿਨ੍ਹਾਂ ਨੇ ਆਪਣੀ ਸੇਵਾਮੁਕਤੀ ਦੀ ਮਿਤੀ 'ਤੇ 12 ਮਹੀਨੇ ਦੀ ਸੇਵਾ ਪੂਰੀ ਕਰ ਲਈ ਹੈ। ਉਹਨਾਂ ਦੇ ਪੈਨਸ਼ਨਰੀ ਲਾਭਾਂ ਦੀ ਗਣਨਾ ਕਰਨ ਦੇ ਉਦੇਸ਼ ਲਈ ਉਹਨਾਂ ਦੀ ਆਖਰੀ ਖਿੱਚੀ ਗਈ ਤਨਖਾਹ ਨੂੰ ਮੁੜ ਨਿਰਧਾਰਤ ਕਰਨ ਦੇ ਉਦੇਸ਼ ਲਈ। ਇਹ ਵਾਧਾ, ਹਾਲਾਂਕਿ, ਜੇਕਰ ਪੰਜਾਬ ਸਿਵਲ ਸਰਵਿਸਿਜ਼ ਰੂਲਜ਼ ਦੇ ਉਪਬੰਧਾਂ ਦੇ ਅਨੁਸਾਰ ਸਵੀਕਾਰ ਕੀਤਾ ਜਾਂਦਾ ਹੈ, ਭਾਵ ਸੇਵਾ ਰਿਕਾਰਡਾਂ ਦੀ ਤਸਦੀਕ ਦੇ ਅਧੀਨ ਮਨਜ਼ੂਰ ਕੀਤਾ ਜਾਵੇਗਾ।
