Chandigarh, 11 April
CIVIL WRIT PETITION had been filed by Principals of punjab government schools, Certiorari quashing
Clause 3 of the transfer orders dated 13.4.20,
26.4.2020, 09.5.2020, 16.2020, 2.6.2020 &
29.6.2020 (Annexure P-2) and Clause 1 of the
transfer orders dated 9.9.2020, 19.11.2020,
27.11.2020, 29.4.2021 & 1.7.2021 (Annexure
P. 2) qua the petitioners vide which a
condition has been imposed during the
transfer of the petitioners directing them to
continue to hold the charge of the previous
place of posting for three days of a week i.e.
Thursday, Friday and Saturday and for three
days of the week ie Monday, Tuesday and
Wednesday to hold charge on the current
place of posting and such condition being
patently illegal, arbitrary and against the rules
governing the general conditions of service of
the petitioners and therefore, deserves to be
quashed.
Hearing the above writ petition Punjab and Haryana High court ordered that till the next date of hearing, Clauses 1 & 3 of the transfer orders annexure P-2, shall remain stayed. Next daye for hearing will be 20.04.2022.
