'Sorry State': High Court Reprimands Punjab Education Department Over Government School Conditions
CHANDIGARH (October 13):
The Punjab and Haryana High Court has taken a stern stand on the "sorry state of affairs" in government schools across Punjab, delivering a sharp reprimand to the state's Education Department. The Honourable Court expressed "extreme anguish," noting that senior officials appeared to be "completely oblivious" to the ground reality.
A bench presided over by Justice N.S. Shekhawat observed that numerous schools are operating without basic necessities like teachers, principals, and adequate facilities, severely compromising students' education.
Major Court Directive
The Court has directed the Secretary of the Education Department to immediately file a personal affidavit detailing the staff and infrastructure deficiencies in all government middle schools across the state. The matter is scheduled for further hearing on October 14.

A "Sorry State": Citing the example of a school in Beas, Amritsar, the Court noted that the institution for classes VI to VIII operates with just one room. It lacks separate facilities for staff and has no Headmaster or dedicated staff. Its charge is currently held by a Principal who is already overseeing another school.

The Nation's Future: Justice Shekhawat warned the government that the State must remember that "the future of a nation rests with its youth" and that a child's personality is shaped during these foundational years.

A Constitutional Duty: The bench stressed that education is not merely a consumer service but a Constitutional obligation. The government must provide quality education without any discrimination (economic, social, or cultural).
The observations by Justice NS Shekhawat came during the hearing of a petition filed by a Hindi teacher from Gov-ernment Middle School, Tapi-ala, Amritsar, through counsel Sunny Singla. He was seek ing quashing of the authori-ties' action for not relieving him despite a transfer order dated August 31, 2024.

ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਸਰਕਾਰੀ ਸਕੂਲਾਂ ਦੀ 'ਮਾੜੀ ਹਾਲਤ' ਉੱਤੇ ਸਖ਼ਤ ਰੁਖ ਅਖਤਿਆਰ ਕਰਦੇ ਹੋਏ ਪੰਜਾਬ ਸਿੱਖਿਆ ਵਿਭਾਗ ਨੂੰ ਕਰੜੀ ਫਟਕਾਰ ਲਗਾਈ ਹੈ। ਮਾਣਯੋਗ ਅਦਾਲਤ ਨੇ ਕਿਹਾ ਕਿ ਸੀਨੀਅਰ ਅਧਿਕਾਰੀ ਸਥਿਤੀ ਤੋਂ 'ਪੂਰੀ ਤਰ੍ਹਾਂ ਅਣਜਾਣ' ਜਾਪਦੇ ਹਨ, ਜਿਸ 'ਤੇ ਕੋਰਟ ਨੂੰ 'ਬੇਹੱਦ ਦੁੱਖ' ਮਹਿਸੂਸ ਹੋਇਆ ਹੈ।
ਜਸਟਿਸ ਐਨ.ਐਸ. ਸ਼ੇਖਾਵਤ 'ਤੇ ਆਧਾਰਿਤ ਬੈਂਚ ਨੇ ਨੋਟ ਕੀਤਾ ਕਿ ਸੂਬੇ ਦੇ ਬਹੁਤ ਸਾਰੇ ਸਕੂਲ ਬਿਨਾਂ ਅਧਿਆਪਕਾਂ, ਪ੍ਰਿੰਸੀਪਲਾਂ ਅਤੇ ਮੁੱਢਲੀਆਂ ਸਹੂਲਤਾਂ ਤੋਂ ਚੱਲ ਰਹੇ ਹਨ, ਜਿਸ ਕਾਰਨ ਵਿਦਿਆਰਥੀਆਂ ਦੀ ਪੜ੍ਹਾਈ ਪ੍ਰਭਾਵਿਤ ਹੋ ਰਹੀ ਹੈ।
ਵੱਡਾ ਹੁਕਮ: ਕੋਰਟ ਨੇ ਸਿੱਖਿਆ ਵਿਭਾਗ ਦੇ ਸਕੱਤਰ ਨੂੰ ਨਿਰਦੇਸ਼ ਦਿੱਤੇ ਹਨ ਕਿ ਉਹ ਤੁਰੰਤ ਇੱਕ ਨਿੱਜੀ ਹਲਫ਼ਨਾਮਾ (personal affidavit) ਦਾਖਲ ਕਰਨ, ਜਿਸ ਵਿੱਚ ਸੂਬੇ ਦੇ ਸਾਰੇ ਸਰਕਾਰੀ ਮਿਡਲ ਸਕੂਲਾਂ ਵਿੱਚ ਬੁਨਿਆਦੀ ਢਾਂਚੇ ਅਤੇ ਸਟਾਫ ਦੀਆਂ ਕਮੀਆਂ ਦਾ ਵੇਰਵਾ ਦਿੱਤਾ ਜਾਵੇ। ਇਸ ਮਾਮਲੇ 'ਤੇ ਅਗਲੀ ਸੁਣਵਾਈ ਹੁਣ 14 ਅਕਤੂਬਰ ਨੂੰ ਹੋਵੇਗੀ।
ਅਦਾਲਤ ਨੇ ਅੰਮ੍ਰਿਤਸਰ, ਬਿਆਸ ਦੇ ਇੱਕ ਸਕੂਲ ਦੀ ਉਦਾਹਰਣ ਦਿੰਦਿਆਂ ਇਸ ਨੂੰ 'ਸੌਰੀ ਸਟੇਟ ਆਫ ਅਫੇਅਰਜ਼' ਕਰਾਰ ਦਿੱਤਾ। ਕੋਰਟ ਨੇ ਦੱਸਿਆ ਕਿ ਉੱਥੇ ਛੇਵੀਂ ਤੋਂ ਅੱਠਵੀਂ ਜਮਾਤ ਲਈ ਸਿਰਫ਼ ਇੱਕ ਕਮਰਾ ਹੈ, ਸਟਾਫ਼ ਲਈ ਕੋਈ ਵੱਖਰੀ ਸਹੂਲਤ ਨਹੀਂ ਹੈ, ਅਤੇ ਕੋਈ ਹੈੱਡ ਮਾਸਟਰ ਜਾਂ ਹੋਰ ਸਟਾਫ਼ ਤਾਇਨਾਤ ਨਹੀਂ ਹੈ।
ਜਸਟਿਸ ਸ਼ੇਖਾਵਤ ਨੇ ਸਰਕਾਰ ਨੂੰ ਚੇਤਾਵਨੀ ਦਿੱਤੀ ਕਿ ਸਿੱਖਿਆ ਕੋਈ ਉਪਭੋਗਤਾ ਸੇਵਾ ਨਹੀਂ, ਸਗੋਂ ਇੱਕ ਸੰਵਿਧਾਨਕ ਜ਼ਿੰਮੇਵਾਰੀ ਹੈ। ਉਨ੍ਹਾਂ ਜ਼ੋਰ ਦਿੱਤਾ ਕਿ ਰਾਜ ਨੂੰ ਯਾਦ ਰੱਖਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ "ਇੱਕ ਕੌਮ ਦਾ ਭਵਿੱਖ ਇਸ ਦੀ ਜਵਾਨੀ ਦੇ ਨਾਲ ਹੈ" ਅਤੇ ਸਰਕਾਰ ਨੂੰ ਬਿਨਾਂ ਕਿਸੇ ਵਿਤਕਰੇ ਦੇ ਮਿਆਰੀ ਸਿੱਖਿਆ ਪ੍ਰਦਾਨ ਕਰਨੀ ਚਾਹੀਦੀ ਹੈ।ਇਹ ਖ਼ਬਰ ਇੱਕ ਸਰਕਾਰੀ ਸਕੂਲ ਦੇ ਹਿੰਦੀ ਅਧਿਆਪਕ ਦੀ ਤਬਾਦਲਾ ਰੱਦ ਕਰਵਾਉਣ ਵਾਲੀ ਪਟੀਸ਼ਨ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਅਦਾਲਤ ਦੀਆਂ ਵੱਡੀਆਂ ਟਿੱਪਣੀਆਂ 'ਤੇ ਆਧਾਰਿਤ ਹੈ।। ਜਸਟਿਸ ਐਨਐਸ ਸ਼ੇਖਾਵਤ ਨੇ ਇਹ ਟਿੱਪਣੀਆਂ ਸਰਕਾਰੀ ਮਿਡਲ ਸਕੂਲ, ਟਾਪੀ-ਆਲਾ, ਅੰਮ੍ਰਿਤਸਰ ਦੇ ਇੱਕ ਹਿੰਦੀ ਅਧਿਆਪਕ ਦੁਆਰਾ ਵਕੀਲ ਸੰਨੀ ਸਿੰਗਲਾ ਰਾਹੀਂ ਦਾਇਰ ਪਟੀਸ਼ਨ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਕੀਤੀਆਂ। ਉਹ 31 ਅਗਸਤ, 2024 ਦੇ ਤਬਾਦਲੇ ਦੇ ਹੁਕਮ ਦੇ ਬਾਵਜੂਦ ਉਸਨੂੰ ਰਾਹਤ( Relive) ਨਾ ਦੇਣ ਲਈ ਅਧਿਕਾਰੀਆਂ ਦੀ ਕਾਰਵਾਈ ਨੂੰ ਰੱਦ ਕਰਨ ਦੀ ਮੰਗ ਕਰ ਰਹੇ ਸਨ।
