ਪੰਜਾਬ ਸਟੇਟ ਪਾਵਰ ਕਾਰਪੋਰੇਸ਼ਨ ਦੇ ਰਿਟਾਇਰਡ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਬਕਾਏ ਦੀ ਰਕਮ ਜਾਰੀ ਕਰਨ ਦੇ ਹੁਕਮ
ਚੰਡੀਗੜ੍ਹ, 12 ਸਤੰਬਰ 2024 ( ਜਾਬਸ ਆਫ ਟੁਡੇ) ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਟੇਟ ਪਾਵਰ ਕਾਰਪੋਰੇਸ਼ਨ ਲਿਮਟਿਡ (PSPCL) ਨੂੰ ਜਸਪਾਲ ਸਿੰਘ ਅਤੇ ਹੋਰ ਪਟੀਸ਼ਨਰਾਂ ਦੀ ਸੋਧੀ ਹੋਈ ਪੈਨਸ਼ਨ ਅਤੇ ਬਕਾਏ ਜਾਰੀ ਕਰਨ ਦੇ ਹੁਕਮ ਜਾਰੀ ਕੀਤੇ ਹਨ। ਪਟੀਸ਼ਨਰਾਂ, ਜੋ PSPCL ਦੇ ਰਿਟਾਇਰਡ ਕਰਮਚਾਰੀ ਹਨ, ਨੇ 1 ਜਨਵਰੀ 2016 ਤੋਂ 30 ਜੂਨ 2021 ਤੱਕ ਦੇ ਛੇਵੇਂ ਤਨਖਾਹ ਕਮਿਸ਼ਨ ਦੇ ਮੁਤਾਬਕ ਪੈਂਸ਼ਨ ਫਾਇਦੇ ਅਤੇ ਬਕਾਏ ਦੀ ਰਕਮ ਜਾਰੀ ਕਰਨ ਦੀ ਮੰਗ ਕੀਤੀ ਸੀ।
ਇਹ ਮਾਮਲਾ ਮਾਣਯੋਗ ਜਸਟਿਸ ਨਮਿਤ ਕੁਮਾਰ ਸਾਹਮਣੇ ਪੇਸ਼ ਕੀਤਾ ਗਿਆ। ਪਟੀਸ਼ਨਰਾਂ ਨੇ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਰਾਜ 'ਚ ਛੇਵੇਂ ਤਨਖਾਹ ਕਮਿਸ਼ਨ ਦੇ ਲਾਗੂ ਹੋਣ ਦੇ ਬਾਵਜੂਦ ਉਹਨਾਂ ਨੂੰ ਪੈਨਸ਼ਨ ਫਾਇਦੇ ਅਤੇ ਬਕਾਏ ਦੀ ਰਕਮ ਨਹੀਂ ਮਿਲੀ। ਉਨ੍ਹਾਂ ਨੇ ਆਪਣੀ ਪੈਨਸ਼ਨ ਨੂੰ 113% ਦੀ ਥਾਂ 125% ਮਹਿੰਗਾਈ ਭੱਤਾ ਦੇ ਅਧਾਰ 'ਤੇ ਸੋਧਣ ਅਤੇ 15% ਹੋਰ ਲਾਭ ਦੇਣ ਦੀ ਮੰਗ ਕੀਤੀ।
ਕਾਰਵਾਈ ਦੌਰਾਨ, ਪਟੀਸ਼ਨਰਾਂ ਦੇ ਕਾਨੂੰਨੀ ਵਕੀਲ ਨੇ ਜ਼ੋਰ ਦਿੱਤਾ ਕਿ ਲੰਮੇ ਸਮੇਂ ਤੋਂ ਬਕਾਏ ਪੈਨਸ਼ਨ ਦੀ ਗਿਣਤੀ ਕਰਕੇ ਇਹ ਰਕਮ ਜਾਰੀ ਕੀਤੀ ਜਾਵੇ। ਰਾਜ ਸਰਕਾਰ ਅਤੇ PSPCL ਦੇ ਪ੍ਰਤੀਨਿਧੀਆਂ ਨੇ ਇਸ ਬਾਰੇ ਕੋਈ ਵੀ ਵਿਰੋਧ ਨਹੀਂ ਕੀਤਾ।
ਕੋਰਟ ਨੇ ਹੁਕਮ ਦਿੱਤਾ ਹੈ ਕਿ ਜਵਾਬ ਦੇਣ ਵਾਲੇ ਪਾਰਟੀਆਂ 21 ਮਈ 2024 ਦੇ ਕਾਨੂੰਨੀ ਨੋਟਿਸ ਦੇ ਅਧਾਰ 'ਤੇ ਪਟੀਸ਼ਨਰਾਂ ਦੀ ਮੰਗ ਨੂੰ ਤਿੰਨ ਮਹੀਨੇ ਦੇ ਅੰਦਰ ਫੈਸਲਾ ਕਰਨ। ਜੇਕਰ ਪਟੀਸ਼ਨਰਾਂ ਨੂੰ ਬਕਾਏ ਦੇ ਕਾਬਿਲ ਪਾਇਆ ਜਾਂਦਾ ਹੈ, ਤਾਂ ਲੋੜੀਂਦੇ ਵਿੱਤੀ ਲਾਭ ਤਿੰਨ ਹਫਤਿਆਂ ਦੇ ਅੰਦਰ ਜਾਰੀ ਕੀਤੇ ਜਾਣਗੇ।
ਇਸ ਫੈਸਲੇ ਨਾਲ ਉਹ ਰਿਟਾਇਰਡ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਵੱਡੀ ਰਹਾਤ ਮਿਲੀ ਹੈ, ਜੋ ਪਿਛਲੇ ਪੰਜ ਸਾਲਾਂ ਤੋਂ ਆਪਣੇ ਹੱਕਾਂ ਲਈ ਇੰਤਜ਼ਾਰ ਕਰ ਰਹੇ ਸਨ। ਇਹ ਮਾਮਲਾ ਪੰਜਾਬ ਵਿੱਚ ਲੰਬੇ ਸਮੇਂ ਤੋਂ ਲਟਕ ਰਹੇ ਪੈਨਸ਼ਨ ਦੇ ਬਕਾਏ ਲਈ ਇੱਕ ਮਿਸਾਲ ਬਣਿਆ ਹੈ।
ਪਟੀਸ਼ਨਰਾਂ ਨੇ ਕੋਰਟ ਦੇ ਇਸ ਫੈਸਲੇ ਦਾ ਸਵਾਗਤ ਕੀਤਾ ਹੈ ਅਤੇ ਉਮੀਦ ਜਤਾਈ ਹੈ ਕਿ ਸਰਕਾਰ ਜਲਦੀ ਹੀ ਹੁਕਮਾਂ ਨੂੰ ਲਾਗੂ ਕਰੇਗੀ।
**High Court Orders Payment of Arrears for Retired Employees of Punjab State Power Corporation**
Chandigarh, September 12 2024– In a significant ruling, the Punjab and Haryana High Court has directed the Punjab State Power Corporation Limited (PSPCL) to release the revised pension and arrears of Jaspal Singh and other petitioners. The petitioners, retired employees of PSPCL, had sought the release of their pending pensionary benefits, revised pay, and arrears as per the Sixth Pay Commission from January 1, 2016, to June 30, 2021.
The case, presented before Hon'ble Justice Namit Kumar, highlighted the non-payment of pensionary benefits, including arrears, despite the implementation of the Sixth Pay Commission in the state. The petitioners argued for the revision of their pension based on 125% Dearness Allowance (DA) instead of the previously calculated 113% DA, as well as an additional 15% benefit.
During the proceedings, the legal counsel representing the petitioners emphasized that the pension revision and arrears were long overdue, causing financial distress to the retired employees. The respondents, including representatives of the Punjab State Government and PSPCL, raised no objections to the claims.
The court has directed the respondents to review and decide the petitioners' claims based on a legal notice dated May 21, 2024, within a three-month period. If the petitioners are found entitled to their demands, the necessary financial benefits must be released within three weeks thereafter.
This ruling offers much-needed relief to retired employees who have been waiting for their dues for over five years. The case has set a precedent for similar claims regarding delayed pension payments in Punjab.
The petitioners have welcomed the court's decision and expressed hope that the government will implement the order promptly.
