Punjab and Haryana High Court Puts Stay on Recovery of Commuted Pension

The Punjab and Haryana High Court has passed interim orders in various writ petitions to stay the recovery of commuted pension. The order applies to pensioners who challenged the recovery of the commuted value of their pension.
A copy of the interim order passed in one such case (CWP 2490 of 2024 titled Ram Saroop Jindal Vs State of Punjab) is enclosed with the document.
The order instructs all Pension Disbursing Banks in the State of Punjab to stop recovering the commuted value of pension from pensioners until the vacation of the stay orders.
What is Commuted Pension?
Commuted pension is a lump sum amount that a retiree can opt for in lieu of a part of their monthly pension. The amount is calculated based on a formula that considers the retiree's age, years of service, and the amount of pension they are entitled to.
Why was Recovery of Commuted Pension Stopped?
The pensioners who challenged the recovery argued that the recovery was unfair or illegal.
What Does This Mean for Pensioners?
The stay order is a temporary relief for pensioners who are having their commuted pension recovered. It means that the recovery will be stopped until the court decides the case.

ਚੰਡੀਗੜ੍ਹ, 29 ਜੂਨ 2024: ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਸ਼ੁਕਰਵਾਰ ਨੂੰ ਇੱਕ ਪੱਤਰ ਜਾਰੀ ਕਰਕੇ ਪੈਨਸ਼ਨਰਾਂ ਤੋਂ ਕੱਟੀ ਗਈ ਕਮਿਊਟੇਡ ਪੈਨਸ਼ਨ ਦੀ ਰਿਕਵਰੀ 'ਤੇ ਰੋਕ ਲਗਾ ਦਿੱਤੀ ਹੈ। ਇਹ ਫੈਸਲਾ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈਕੋਰਟ ਵੱਲੋਂ ਵੱਖ-ਵੱਖ ਸਿਵਲ ਰਿਟ ਪਟੀਸ਼ਨਾਂ ਵਿੱਚ ਪਾਸ ਕੀਤੇ ਗਏ ਅੰਤਰਿਮ ਆਦੇਸ਼ਾਂ ਦੀ ਪਾਲਣਾ ਵਿੱਚ ਲਿਆ ਗਿਆ ਹੈ।
ਨੋਟੀਫਿਕੇਸ਼ਨ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਹਾਈਕੋਰਟ ਨੇ ਵੱਖ-ਵੱਖ ਰਿਟ ਪਟੀਸ਼ਨਾਂ ਵਿੱਚ ਕਮਿਊਟੇਡ ਪੈਨਸ਼ਨ ਦੀ ਰਿਕਵਰੀ 'ਤੇ "ਰੋਕ" ਲਗਾਉਣ ਦੇ ਅੰਤਰਿਮ ਆਦੇਸ਼ ਪਾਸ ਕੀਤੇ ਹਨ।
ਇਸ ਨੋਟੀਫਿਕੇਸ਼ਨ ਦੀ ਇੱਕ ਕਾਪੀ ਜੋ ਕਿ CWP 2490 of 2024 ਵਿੱਚ ਪਾਸ ਕੀਤੇ ਗਏ ਅੰਤਰਿਮ ਆਦੇਸ਼ ਦੀ ਇੱਕ ਕਾਪੀ ਜਿਸ ਵਿੱਚ ਰਾਮ ਸਰੂਪ ਜਿੰਦਲ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਖ਼ਿਲਾਫ਼ ਮੁਕੱਦਮਾ ਦਰਜ ਕੀਤਾ ਸੀ, ਨੂੰ ਇਸ ਦੇ ਨਾਲ ਜੋੜਿਆ ਗਿਆ ਹੈ।
ਨੋਟੀਫਿਕੇਸ਼ਨ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਹਾਈਕੋਰਟ ਵੱਲੋਂ ਵੱਖ-ਵੱਖ ਰਿਟ ਪਟੀਸ਼ਨਾਂ ਵਿੱਚ ਪਾਸ ਕੀਤੇ ਗਏ "ਰੋਕ" ਆਦੇਸ਼ਾਂ ਦੀ ਪਾਲਣਾ ਵਿੱਚ ਯਾਚੀਕਰਤਾਵਾਂ ਤੋਂ ਕਮਿਊਟੇਡ ਪੈਨਸ਼ਨ ਦੀ ਰਿਕਵਰੀ ਦੀ ਪ੍ਰਕਿਰਿਆ ਰੋਕ ਦਿੱਤੀ ਗਈ ਹੈ ਜਦੋਂ ਤੱਕ ਕਿ ਰੋਕ ਆਦੇਸ਼ਾਂ ਨੂੰ ਰੱਦ ਨਹੀਂ ਕੀਤਾ ਜਾਂਦਾ।
ਇਸ ਨੋਟੀਫਿਕੇਸ਼ਨ ਦੀ ਇੱਕ ਕਾਪੀ ਅਕਾਊਂਟੈਂਟ ਜਨਰਲ (ਏ ਐਂਡ ਈ), ਪੰਜਾਬ, ਸੈਕਟਰ 17-ਈ, ਚੰਡੀਗੜ੍ਹ; ਵਿੱਤ ਵਿਭਾਗ, ਪੰਜਾਬ, ਚੰਡੀਗੜ੍ਹ ਦੇ ਵਿੱਤ ਪੈਨਸ਼ਨ ਨੀਤੀ ਅਤੇ ਤਾਲਮੇਲ ਸ਼ਾਖਾ ਦੇ ਅੰਡਰ ਸਕੱਤਰ; ਅਤੇ ਪੰਜਾਬ ਰਾਜ ਦੇ ਸਾਰੇ ਜ਼ਿਲ੍ਹਾ ਟ੍ਰੇਜ਼ਰੀ ਅਧਿਕਾਰੀਆਂ ਨੂੰ ਵੀ ਭੇਜੀ ਗਈ ਹੈ।
ਇਸ ਨੋਟੀਫਿਕੇਸ਼ਨ ਦਾ ਮਹੱਤਵ
ਇਹ ਨੋਟੀਫਿਕੇਸ਼ਨ ਪੰਜਾਬ ਦੇ ਹਜ਼ਾਰਾਂ ਪੈਨਸ਼ਨਰਾਂ ਲਈ ਇੱਕ ਵੱਡੀ ਰਾਹਤ ਹੈ, ਜਿਨ੍ਹਾਂ ਤੋਂ ਉਨ੍ਹਾਂ ਦੀ ਕਮਿਊਟੇਡ ਪੈਨਸ਼ਨ ਦੀ ਰਕਮ ਵਸੂਲ ਕੀਤੀ ਜਾ ਰਹੀ ਸੀ। ਹਾਈਕੋਰਟ ਦੇ ਅੰਤਰਿਮ ਆਦੇਸ਼ਾਂ ਨੇ ਇਨ੍ਹਾਂ ਪੈਨਸ਼ਨਰਾਂ ਨੂੰ ਕੁਝ ਰਾਹਤ ਦਿੱਤੀ ਹੈ, ਅਤੇ ਇਹ ਨੋਟੀਫਿਕੇਸ਼ਨ ਉਸ ਰਾਹਤ ਨੂੰ ਕਾਨੂੰਨੀ ਰੂਪ ਦਿੰਦਾ ਹੈ।
