Punjab government clarifies that NOC is not required for registration of documents in Abadi Deh areas

The Punjab government has clarified that a No Objection Certificate (NOC) is not required for registration of documents in respect of land falling under the Abadi Deh areas.
The clarification comes after the government received reports that some Sub-Registrars/Joint Sub-Registrars were insisting on a NOC for registration of deeds even in cases of sale of land falling under the Abadi Deh areas.
The Abadi Deh is an area that is not considered to be a planned area under the Punjab Apartment and Property Regulation Act. Therefore, the provision under Section 20(3) of the Act, which requires an NOC for registration of documents in colonies, does not apply to Abadi Deh areas.
The government has issued a notice to all relevant officials, clarifying that a NOC is not required for registration of documents in Abadi Deh areas.
ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਹੈ ਕਿ ਅਬਾਦੀ ਦੇਹ ਖੇਤਰ ਅਧੀਨ ਆਉਂਦੀਆਂ ਜ਼ਮੀਨਾਂ ਸਬੰਧੀ ਦਸਤਾਵੇਜ਼ਾਂ ਦੀ ਰਜਿਸਟ੍ਰੇਸ਼ਨ ਲਈ ਕੋਈ ਇਤਰਾਜ਼ ਨਹੀਂ ਸਰਟੀਫਿਕੇਟ (ਐਨਓਸੀ) ਦੀ ਲੋੜ ਨਹੀਂ ਹੈ।
ਇਹ ਸਪੱਸ਼ਟੀਕਰਨ ਸਰਕਾਰ ਨੂੰ ਰਿਪੋਰਟਾਂ ਮਿਲਣ ਤੋਂ ਬਾਅਦ ਆਇਆ ਹੈ ਕਿ ਕੁਝ ਸਬ-ਰਜਿਸਟਰਾਰ/ਜੁਆਇੰਟ ਸਬ-ਰਜਿਸਟਰਾਰ ਅਬਾਦੀ ਦੇਹ ਖੇਤਰਾਂ ਦੇ ਅਧੀਨ ਆਉਂਦੀਆਂ ਜ਼ਮੀਨਾਂ ਦੀ ਵਿਕਰੀ ਦੇ ਮਾਮਲਿਆਂ ਵਿੱਚ ਵੀ ਡੀਡਾਂ ਦੀ ਰਜਿਸਟ੍ਰੇਸ਼ਨ ਲਈ ਐਨਓਸੀ ਲਈ ਜ਼ੋਰ ਦੇ ਰਹੇ ਸਨ।
ਅਬਾਦੀ ਦੇਹ ਇੱਕ ਅਜਿਹਾ ਖੇਤਰ ਹੈ ਜਿਸ ਨੂੰ ਪੰਜਾਬ ਅਪਾਰਟਮੈਂਟ ਅਤੇ ਪ੍ਰਾਪਰਟੀ ਰੈਗੂਲੇਸ਼ਨ ਐਕਟ ਦੇ ਤਹਿਤ ਇੱਕ ਯੋਜਨਾਬੱਧ ਖੇਤਰ ਨਹੀਂ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ। ਇਸ ਲਈ, ਐਕਟ ਦੇ ਸੈਕਸ਼ਨ 20(3) ਦੇ ਤਹਿਤ ਉਪਬੰਧ, ਜਿਸ ਲਈ ਕਾਲੋਨੀਆਂ ਵਿੱਚ ਦਸਤਾਵੇਜ਼ਾਂ ਦੀ ਰਜਿਸਟ੍ਰੇਸ਼ਨ ਲਈ NOC ਦੀ ਲੋੜ ਹੁੰਦੀ ਹੈ, ਅਬਾਦੀ ਦੇਹ ਖੇਤਰਾਂ 'ਤੇ ਲਾਗੂ ਨਹੀਂ ਹੁੰਦਾ।
ਸਰਕਾਰ ਨੇ ਸਾਰੇ ਸਬੰਧਤ ਅਧਿਕਾਰੀਆਂ ਨੂੰ ਨੋਟਿਸ ਜਾਰੀ ਕਰਕੇ ਸਪੱਸ਼ਟ ਕੀਤਾ ਹੈ ਕਿ ਅਬਾਦੀ ਦੇਹ ਖੇਤਰਾਂ ਵਿੱਚ ਦਸਤਾਵੇਜ਼ਾਂ ਦੀ ਰਜਿਸਟ੍ਰੇਸ਼ਨ ਲਈ ਐਨਓਸੀ ਦੀ ਲੋੜ ਨਹੀਂ ਹੈ।
